West Point Board Declines Separation, Retains Accomplished Officer

September 18, 2024, U.S. v. O-3, United States Military Academy, West Point, New York. Captain at the United States Military Academy at West Point was accused of making a false official statement. The officer was alleged to have allowed cadets to consume alcohol during a student-athlete trip. When a subsequent investigation was launched, the Captain was then accused of being untruthful during the 15-6 Investigation. This was considered an alleged violation of the Academy's Honor Code: “A cadet will not lie, cheat, steal, or tolerate those who do.” The Captain retained the firm, and Mr. Gapasin was assigned to represent the Client. The Academy elects to proceed with a Board of Inquiry, and the Government seeks to separate this highly accomplished officer with an Other Than Honorable discharge. Mr. Gapasin presents strong evidence of the Captain's exemplary duty performance and outstanding military character.
