Are You Being Referred For Disenrollment From ROTC?

Many Cadets who are being referred for disenrollment face funding their college education on their own dime, losing their scholarship, or being denied “guaranteed” benefits they were expecting to receive after completing the ROTC program. Many Cadets who are subject to an investigation that could lead to disenrollment are not given the proper due process. Before an investigation is even conducted, some Cadets are already "guilty before proven innocent". This rush to judgment by he PMS and the Cadet's leadership does not just lead to the end of a military career and the stigma of having been found substantiated for misconduct, but the loss of thousands and thousands of dollars of advanced educational assistance money.
Many military attorneys are not familiar with ROTC Disenrollment hearings, but Mr. Gapasin has been involved in several ROTC disenrollment procedures in his practice. Much like in the regular Active Duty branches of the military, a disenrollment hearing is also referred to as a board which is presided over by either a Board of Officers or an Investigating Officer. Generally though, the board is presided over by one Investigating Officer as opposed to a board of three (3) officers. Also like boards in the military, ROTC Disenrollment hearings follow a particular script that is provided for in regulations. The Board of Officers or Investigating Officer hears evidence and determines whether or not the cadet breached the terms of their ROTC Cadet Contract, and makes a determination of their suitability for retention in the ROTC program.
This investigation results in a finding and recommendation by the fact-finder as to whether or not the cadet should be disenrolled from ROTC for breach of terms of the contract. Additionally, the hearing officer will submit their findings and recommendations to the Commanding General, USACC for appropriate disposition and as to the validity of any indebtedness the cadet owes to the U.S. Government. This can be equally devastating because many cadets only go to that particular college because of the thousands of dollars in scholarship money that they received through the ROTC contract. False accusations can not only be the end of a career, but can result in incurring a debt to the Federal Government.
